An Irish magistrate has ruled that money seized by police at a private club in Belfast during the weekend should be given back to its rightful owners.

More than £23,000, as well as card gambling equipment, was seized in a raid of the Cavendish Club on Corporation Street on Saturday during a game of Texas Hold’em.

Card gambling is a weekly activity at the Cavendish Club, which also hosts the online Texas Hold’em Open, featured on Sky TV.

Because the owner of the Cavendish club does not take a cut, or rake, of the card gambling proceeds, Magistrate Desmond Perry held that the activity is in fact legal.

Club owner Sean Murphy said that he hosts the card gambling games in order to establish a clientele in the case that gambling is legalized in Ireland in the near future, but that he does not currently make any profit from the games.

Defense attorney Kevin Winters said: “The law covering the playing of poker needs to be sorted out. My client is satisfied with the outcome of the case but takes issue with the heavy-handed manner in which this case was brought to court.”
